Credit Card Theft in New Jersey

According to N.J.S.A. 2C:21-6, there are a number of offenses that constitute credit card theft under New Jersey law. The following is an outline of each of the actions that may lead to credit card theft charges.

  • A person takes or obtains the credit card of another person without the cardholder’s consent.
  • A person receives a credit card that he or she knows has been taken, with the intent to use it, sell it, or transfer it to another person other than the issuer or the cardholder.
  • A person receives a credit card that he or she knows been lost, mislaid, or delivered by mistake, and retains possession with the intent to use it, sell it, or transfer it to another person other than the issuer or the cardholder.
  • A person, other than the issuer, sells a credit card.
  • A person buys a credit card from another person, other than the issuer.
  • A person, with the intent to defraud the issuer, a person, or organization, obtains control over a credit card as security for a debt.
  • A person other than the cardholder or a person authorized by him or her, with intent to defraud the issuer, a person, or organization, signs a credit card.

All of the above offenses are classified as fourth degree crimes, which are punishable by a New Jersey State Prison sentence of up to 18 months, as well as a fine of up to $10,000. If a person possesses credit cards issued in the names of 2 or more other people, or possesses 2 or more stolen credit cards, he or she is presumed to have committed credit card theft.

Falsely Making or Embossing a Credit Card in New Jersey

Notably, there is another offense which is considered credit card theft in New Jersey, which involves making or embossing false credit cards. Specifically, if a person, with the intent to defraud a purported issuer, person, or organization, falsely makes or falsely embosses a credit card or presents such a card, he or she may be charged with credit card theft. If a person possesses 2 or more falsely made or embossed credit cards, he or she is presumed to have committed this offense. This form of credit card theft is classified as a third degree crime, which is punishable by a term of imprisonment ranging from 3 to 5 years, in addition to a fine of up to $15,000.
