New Jersey Oxycontin Charges

The degree of your Oxycontin charges will depend on the number of pills involved and the nature of the offense (whether or not you are accused of distributing Oxy or possessing the drug with intent to distribute). Below is an explanation of the various charges for Oxycodone that you may face in New Jersey.

Oxycontin Possession 2C:35-10.5

Simple possession of Oxycontin can be a disorderly persons offense or a fourth degree crime. Unlawfully possessing four or fewer dosage units of Oxycontin is a disorderly persons offense, punishable by up to 6 months in jail, a $1,000 fine, and a 6-month driver’s license suspension. Possession of five or more Oxycontin pills is a fourth degree crime, punishable by up to 18 months in NJ State Prison and a maximum fine of $10,000.

Distribution and Intent to Distribute Oxycontin 2C:35-10.5

A charge for distributing or intent to sell Oxycontin is graded based on the number of pills in your specific case. The grading of these charges is as follows:

  • 4 or Fewer Pills: fourth degree crime
  • 5 to 99 pills: third degree crime
  • 100 or more pills: second degree crime

Fourth degree Oxycontin charges may result in up to 18 months of incarceration. Third degree charges for Oxy are punishable by 3 to 5 years and a fine of up to $200,000. Second degree charges for distributing Oxycodone are the most severe. As such, you are exposed to a prison sentence ranging from 5 to 10 years and a fine up to $300,000.

Use or Being under the Influence of Oxycontin 2C:35-10.5

If you are accused of using or being under the influence of Oxycontin for a purpose other than the treatment of illness or injury as lawfully prescribed or administered by a licensed physician, veterinarian, dentist or other practitioner authorized by law to prescribe medication, this is a disorderly persons offense in New Jersey. If convicted of a disorderly persons offense for using Oxycontin, you may be sentenced to 6 months in jail, a fine of $1,000, and you will have a criminal record.

Obtaining Oxycontin by Fraud 2C:35-13

It is a third degree crime in New Jersey to obtain a prescription for Oxycontin through misrepresentation, fraud, forgery, deception or subterfuge. In other words, if a person uses misleading means to acquire an Oxycodone prescription, they can be charged with a violation of N.J.S.A. 2C:35-13 and exposed to up to 5 years in prison.
